In meinem wohlverdienten :) Urlaub traf mich die Nachricht, dass der Fall "Madeleine McCann" einer Untersuchung durch eine britische Polizeidirektion unterzogen werden soll oder gerade wird.
Dies erschien mir erst als weiteres Ablenkungsmanöver der Briten und eine Goodwill Aktion des Innenministeriums den McCanns gegenüber. Die Untersuchung würde wohl weitere entlastende Beweise für das Paar und weitere belastende Beweise gegen den großen Unbekannten zu Tage fördern.
Einige Berichte hatte ich gestern kurz überflogen, das Internet funktioniert hier nicht sonderlich gut. Heute Nacht jedoch wachte ich auf und hatte einen jener Momente, in denen das Unterbewusstsein wohl während des Schlafes arbeitet und ein "Geistesblitz" einen aufwachen lässt. Ich nahm mir noch einmal die Presseberichte vor und tatsächlich da war es: Die "Review" sollte nicht von Scotland Yard oder der Leicestershire Polizei oder irgendeiner anderen Polizeidirektion durchgeführt werden, sondern ausgerechnet von der West Yorkshire Police. Im Schlaf hatte sich scheinbar das Puzzlestück an seinen Platz geschoben. Aachen und der Oberstaatsanwalt Robert Deller kamen mir ins Gedächtnis zurück. Die West Yorkshire Police war mit einem Rechtshilfegesuch nach Aachen gekommen um eine DNA Probe von Raymond Hewlett zu nehmen (obwohl bereits eine vorgelegen haben musste).
Warum von allen Polizeidirektionen der Insel ausgerechnet die West Yorkshire Police? Für mich gibt es da nur einen möglichen Grund. Ein Ende des Falles soll sich anbahnen mit einem Sündenbock Hewlett. Ob mit oder ohne seinem Einverständnis wird sich möglicherweise mit neuen technischen Mitteln auf dem Gebiet der DNA Analyse herausstellen, dass der Spermafleck auf dem Bett oder eine andere forensische Probe nun doch von He. Hewlett stammt, auch wenn der zum Tatzeitpunkt garnicht vor Ort war. Mit Kleinigkeiten kann man sich jetzt nicht mehr abgeben, die Wahlen nahen!!!
Daher dieser schnell hingeschluderte Blogeintrag um die Befürchtungen zu dokumentieren bevor sie eintreten. Weitere Massnahmen habe ich bereits ins Auge gefasst. Das DNA Profil von der Bettdecke ist jedenfalls dokumentiert, sofern man Paulo Rebelo trauen kann:

I know of only one sighting in the files that involves movements of a suspect around the resort on the day Madeleine disappeared. Let me state the corresponding file:

Während die Buchveröffentlichung des Kriegshetzers Tony Blair größtmögliche Schlagzeilen macht, u.a. mit der Aussage er sei von Gordon Brown erpresst worden (hmmmmm), wurde heute die wohl unglaubwürdigste Geschichte seit dem 3. Mai 2007 veröffentlicht.
Unser Freund Hewlett (ich wusste ja, dass er noch lange nicht ausgedient hat, auch wenn er längst in der Pädophilenhölle schmort) soll angeblich seinem Sohn eine Nachricht aus dem Jenseits geschickt haben, mit Hilfe eines mysteriösen Fremden, ein Anwalt oder Privatdetektiv, in der er jede Beihilfe zur Entführung Madeleine's abstreitet aber erklärt, er wisse, wer sie entführt hätte.
Zigeuner (darf man den Begriff überhaupt verwenden?) hätten sie für Leute, die sie quasi aus einem Katalog ausgewählt hätten, beschafft. Natürlich keine bösen Leute, sondern grundgute kinderlose Ehepaare würden von diesen Zigeunern seit Jahren mit kleinen Kindern versorgt.
Präsident Sarkozy wirds freuen, ein Grund mehr die Roma aus Frankreich auszuweisen, die haben ja schon immer Kinder geklaut. Nun haben wir es dank Antonella Lazzari und der SUN endlich schwarz auf weiß.
Kein denkender Mensch wird diese Geschichte für glaubwürdig halten, zumal der Sohn diesen absolut wichtigen Beweis nicht zur Polizei brachte, sondern erst einmal vorsichtshalber verbrannte. Asche zu Asche und soweiter...
So recht fehlt mir noch der Grund für die Veröffentlichung dieses Märchens, vielleicht hat es mit der Tatsache zu tun, dass Kevin Halligen's Auslieferungsprozess schon wieder vertagt wurde, vielleicht auch damit, dass sowohl Onkel John als auch Gerry's Boss als Direktoren des "Fund" zurückgetreten sind. Handelt es sich um gezielten Rückzug oder Panik? Wird sicher in den nächsten Tagen klarer.
Nachdem gestern der tote Hewlett wieder hervorgekramt wurde, geht es planmässig nun zu Teil 2 der Abwicklung über. Jim Knopf erklärt, die Portugiesen hätten ohne Ende Fehler in ihrer Untersuchung des Falles gemacht und die armen McCanns wären bei einer BRITISCHEN Untersuchung niemals zu Verdächtigen gemacht worden. Wem jetzt nicht klar ist wie der Hase läuft, dem kann ich auch nicht mehr helfen. Offensichtlicher kann sich niemand als Helfershelfer einer strategisch geplanten Vertuschungsaktion outen.
Die Diskrepanzen und Änderungen der Zeugenaussagen alleine - ohne die Indizien der Hunde - hätten jede Polizei der Welt davon überzeugt, dass hier einiges nicht mit rechten Dingen zuging.
Angeblich wird nun noch nach einer Polizeistelle gesucht, die den Fall wieder aufrollen soll. Ich dachte, das wäre schon geschehen und die West Yorkshire Polizei sei damit betraut? War deren Verbindung zu Hewlett nun so offensichtlich, dass man da einen Rückzieher macht und eine weniger offensichtlichere Wahl treffen wird?
Es geht alles seinen prophezeiten Gang. Eine kleine Hoffnung besteht vielleicht noch, dass einem der gescholtenen Beamten der Leicestershire Polizei der Kragen platzt. Aber was mit Polizisten geschehen kann hat man gesehen, als 3 von ihnen innerhalb einer Woche "Selbstmord" begingen.
Vertuschung hin oder her, wenn Jim Knopf der oberste Pädophilenjäger und Kinderschützer der Briten ist, dann Gnade allen Kindern der Inseln...
Bereits seit 4 Monaten soll er schon tot sein, der alte Kinderschänder. Und eingeäschert noch dazu. Bye bye DNA. Das zeugt entweder von völliger Planlosigkeit seitens der McCann Polizei oder es hat einen tieferen Sinn, dass diese Nachricht erst jetzt in der Presse erscheint. Jetzt, 3 Wochen vor dem "Jubiläum" und kurz nachdem die West Yorkshire Polizei ihre "3-Tage-Überprüfung" des Madeleine Falles angehen wollte. Übrigens wollte Dave Edgar lt. dem Daily Star noch Ende Januar mit Hewlett sprechen, der aber da sicher schon mehrere Wochen tot war.
An DNA ist nun nicht mehr heranzukommen denke ich. Warten wir ab wie es sich entwickelt, wie die anderen Blättchen dies aufgreifen und was die offiziellen Stellen dazu sagen. Noch einmal sei darauf hingewiesen, dass es Jim Gamble von der stets hilfreichen CEOP war, der die West Yorkshire Polizei dem Home Office vorgeschlagen hat, den Fall zu überprüfen. Die Polizei, die im Besitz von Hewlett's DNA ist.
Gamble treibt sich übrigens gerade in Washington rum, wo er Facebook dazu zwingen will endlich einen Knopf auf ihren Seiten anzubringen, im Kampf gegen Paedophile. Damit wären CEOP immer die ersten, die von solchen Aktivitäten erfahren. Jim Knopf scheint wirklich in Lummerland zu leben...

It is not about the SEARCH, that has been hindered by the book written by Goncalo Amaral. Because there never has been a SEARCH, not even in the direct aftermath of her disappearance. No SEARCH by Kate during the night of the 3rd, no SEARCH during the following days.
It is about the FUND that indirectly (see Kate's words above) funded the illusion of a SEARCH with the help of the most dodgy and criminal investigators that could be found. Substitute the word SEARCH in every article and statement with the word FUND and you will see what I mean.
And the FUND was indeed damaged by the book written by Amaral. The drop in income used as a fighting fund for the parents, paying for the best lawyers - criminal, libel and extradition - was huge, but did not start with the sale of the book, but with the arguido status of the parents, placed upon them during the criminal investigation the book is based upon.
They want to rewrite history on two fronts. The complete first criminal investigation has to be wiped out of the minds of the public and especially from the internet. Scotland Yard's job on the one hand is to completely discredit the initial PJ investigation with the strongly demanded "Review" and on the other hand they have to fight the book based on that investigation. In order to then be completely whitewashed so that the "rubel can roll again".
Let's see if this plan - originally concocted years ago within completely different parameters surrounding the review - will work out. The offer of a settlement earlier this year and the change of the review into an investigation seem to indicate that not everything is working as intended.

Der Rückgang der Spendengelder, die als "fighting fund" für die Eltern genutzt wurde, der für die besten Anwälte - Strafverteidiger, Verleumdungs- und Auslieferungsanwälte - genutzt wurde, war riesig, aber wurde nicht durch den Verkauf des Buches ausgelöst sondern durch den Arguido Status der Eltern, der ihnen während der Ermittlungen, auf denen das Buch basiert, verliehen wurde.
Sie wollen die Geschichte umschreiben, und zwar an zwei Fronten. Die komplette erste polizeiliche Untersuchung muss aus dem Gedächtnis der Öffentlichkeit und vor allem aus dem Internet gestrichen werden. Einerseits ist es Scotland Yards Job diese Untersuchung der Policia Judiciara durch die verlangte "Review" vollständig zu diskreditieren, andererseits bekämpfen sie selbst das Buch, das auf dieser Untersuchung basiert. Dann völlig reingewaschen kann der Rubel wieder rollen.
Es bleibt abzuwarten ob dieser Plan - ursprünglich ausgeheckt unter komplett anderen personellen Vorraussetzungen im Umfeld der Review - aufgehen wird. Das Angebot einer außergerichtlichen Einigung am Anfang des Jahres und die Umwandlung der Review in eine Untersuchung scheinen zu signalisieren, dass nicht Alles so läuft wie geplant.

To be honest I have read it over and over again until I found this to be the essence of his waffling: "Err but

probably wasn’t until the day previously..." He wasn't sure if he saw her at lunchtime 3rd, which he didn't and he wasn't sure if he saw her at playtime 3rd, which he didn't so the last time he saw her was the day previously at playtime.

Thursday lunchtime he, his wife, Matt and Rachael were having lunch in their apartment with their kids. Fiona allegedly accompanied Kate to the kids club to take their daughters out, not Jane or Russell. And he did not see Madeleine at the creche because in his heavily redacted statement he said: ", I cannot say whether Madeleine was there or not". Ergo the last time he really saw her was the day previously at playtime.

Taking into account that it was Gerry and not David who mentioned this alleged checking of Kate and the kids for the first time during a certainly stressful interview by the PJ and taking also into account that David's and Fiona's versions changed and differed in important points, I assume that this is not a truthful statement and the chances are pretty high that he saw Madeleine for the last time the day previously at playtime.

One person really telling it how it was, almost straight forward. Wednesday was the last time Madeleine was seen, at the high tea or rather in the playground afterwards. But why all this deflection? Why didn't they all say straight away that this was the last time they saw her? Because this would have alerted the PJ immediately. And to further support the alleged fact that she was alive and well plenty of aditional information was fed to the investigation afterwards, like the last photo, the check by David Payne during dinner on May 2nd, the story about Maddie's complaint being told on the morning of the 3rd, the story about her crying on the boat.
Sightings are good, sightings are proof, sightings are the highlights of the Madeleine story, fuelling the hope as well as the donations. But with the unedifying end of Metodo 3 and its main protagonists, especially Antonio Jimenez, the question about the veracity of some of the sightings arises again. And with the question about the sightings those that vouched for them, will have to look at them again with some humbleness. Ok.. joking...!!! I am talking about Tony Parsons who wrote such xenophobic marbles as "Oh, Up Yours Senor" and other trash. Either a mouthpiece for the McCanns or a perfect compass needle pointing exactly in the opposite direction of Truth and where to find it. I am sure there won't be any humbleness from Mr. Parsehole.
Tony used one sighting by an alleged Doctor - the majic word to grant you Tony's trust without any trivial credibility checks - as an example for more than 400 calls about alleged sightings that had to be true simply due to their excessive number.
"Dr."Naoual Malhi, who was ever so close with Metodo 3 and especially with Antonio Jimenez, travelled with him to the Morroccan outlaws, despite the risks for her personal wellbeing just because she had a pure and great heart. This is how Tony described her in one of his diatribes against Portuguese Police:
Clearly an intelligent, compassionate woman, she is so positive that
she saw Madeleine being bundled into a taxi in Fnidk, in northern
Morocco, that she has returned to the country with investigators from
Metodo 3, the Spanish private detectives hired by the McCanns. It is
worth noting that Dr Malhi neither wants nor expects any payment for her
efforts. I believe her.
Perhaps I am an idiot, or merely one of
the millions who wants this terrible story to have a happy ending, but I
still think there is a chance to get Madeleine back. Link

"disappeared" in 2008 and whose mother had also contracted the infamous
Metodo 3.

No need to bother anymore. The PJ had realised their involvement days after she went missing. We have realised their involvement pretty soon. After a thorough look into the files there was no doubt left that they were involved.
And now they are trying to tell us that they need years and millions to "review" the whole thing? LP had the files, they KNEW. But were ordered to do nothing.
I am clear in the knowledge of what happened that holiday. I am also convinced now that they had the means to get help from the Government in their cover-up.
The case is solved for me, my investigative mind is at rest. I have accepted that the world does not want to know the truth and that is fine with me.
There is not much left to discover, just to sit back and watch the final whitewash unfold. There will always be those that know and those that let themselves be deceived.
The McCanns and especially Kate as the main protagonist are not behind bars but have built their own prison worse than anything they would have had to expect had they admitted her death from the beginning.

I am talking about the disappearance of Amy Fitzgerald, a 15 year old girl that vanished in Spain in 2008. While the rest of the media turns the statement of Hamish Campbell that there is still a "good number of people to be quizzed" into a mathematical exercise with the help of CM spin - 20..12..9..5... persons of interest/suspects - the EXPRESS hides very important information behind a rather ludicrous statement about a couple that allegedly entered Maddie's apartment on May 2nd.
The important information is that Scotland Yard interviewed a couple that owns the apartment above Mrs Fenn, who died in March 2011. The couple were interviewed in August 2007 by the BBC but apparently not by the Portuguese police. The important part of their statement is the fact that they passed the entrance of the Tapas Bar on May 3rd shortly after 9:00 pm and that the woman, Mrs. Moyes, was having a drink on the balcony at 9:15 without having noticed anybody in the street where Jane Tanner allegedly saw bundleman abducting Madeleine. Not Jane, not Gerry, not Jez and certainly not bundleman.
The Moyes had arrived in Praia da Luz only a day before the "abduction" on May 2nd and since Mrs. Fenn had been out that evening, might be the only witnesses for another crying episode as described by Mrs. Fenn for May 1st. There is danger in numbers. One dead witness does not count much, but three witnesses confirming the so called "child-care-arrangements" of the Tapas Group have to be taken seriously.
And up pops a mysterious couple that was seen entering the apartment to sooth and comfort the crying Madeleine. Most probably a couple living close to hear the ongoing screaming and who might have noticed the open patio door. And who is the source for this surprising, never-heard-before piece of evidence? The Express sister paper Daily Star today sums up the whole circus quite nicely:

Nicht Jane, nicht Gerry, nicht Jez und sicherlich nicht Bundleman.
Die Moyes waren in Praia da Luz am Tag vor der "Entführung" angekommen, am 2. Mai und da Mrs. Fenn an diesem Abend außer Haus war, könnten sie die einzigen Zeugen für eine weitere "Crying Episode" gewesen sein, wie Mrs. Fenn sie für den 1. Mai beschrieb. Die Gefahr liegt in der Häufigkeit. Eine tote Zeugin mag nicht viel zählen, aber drei Zeugen, die die "Kinderbetreuung" der Tapas Gruppe wirklich bestätigen könnte, wäre ernstzunehmen.
Et voila erscheint ein mysteriöses Ehepaar, das gesehen wurde wie es das Apartment betrat um die schreiende Maddie zu beruhigen. Sehr wahrscheinlich doch ein Ehepaar, das in der Nähe wohnte und das andauernde Schreien hörte und die evtl. offene Balkontür bemerkte. Und wer ist die Quelle für dieses überraschende, nie gehörte Beweisstück? Eine QUELLE

Robert Murat was cleared as a suspect long ago
Marking the sixth
anniversary of her abduction, the Algarve-based businessman says a
48-hour timeline would help police conducting a £4.5million review of
the case.
Mr Murat, who was cleared as a
suspect, said: “They need to start from the beginning.” So far the
two-year review by more than 20 detectives in London has not led to a
breakthrough.
Portugal’s authorities have not
been persuaded to reopen the investigation, although Policia Judiciaria
policewoman Helena Monteiro liaises regularly with officers from the
Yard’s Operation Grange.
Mr Murat, 39, spoke to
the Sunday Express while sipping tea in Casa Liliana, his elderly
mother Jenny’s villa 150 yards from apartment 5a of the Ocean Club where
Madeleine vanished.
He said: “They need to
speak to everybody, including myself, and they need to get the
Portuguese involved in a much more constructive way.
“To
get somewhere now they need to have a joint team working here together
in Praia da Luz. This is where it happened. It didn’t happen in England.
“The reconstruction should cover the critical period just before and after the abduction.”
Madeleine
was three when she disappeared from the apartment at about 9.15pm while
her parents Kate and Gerry McCann and seven friends ate at a tapas bar
nearby. When the Judiciaria named the McCanns as suspects, they and
their friends chose not to take part in a PJ-led reconstruction. It
would be different now that they have been cleared, said Mr Murat.
He
said: “A reconstruction is a real necessity. I am sure it would fill in
some of the missing pieces of the jigsaw. Even now after all this time,
the timeline is still confused.”
Thirteen days
after Madeleine’s disappearance Mr Murat was named as a suspect. His
mother’s home, where he lived then, was searched, his computers were
taken, he was questioned for 19 hours by Portuguese police and his
property business was wrecked.
His eagerness to
help with the original investigation, helping police with translations,
aroused a journalist’s suspicions. Three of the McCanns’ friends
believed they saw him on the night Madeleine vanished but his mother
confirmed to police he was with her all night at Casa Liliana.
After being cleared as a suspect in July 2008 he won substantial damages from newspapers.
Despite his ordeal he believes Madeleine’s fate should be uppermost in everybody’s minds as another anniversary passes.
He said: “You cannot lose sight of the fact that a child was taken and we need to know what happened to her.”
He
is still willing to be interviewed by the review team, which has made
no effort to contact him. “I have no problem with that whatsoever,” he
said emphatically.
“I am available to help on
the proper legal basis. I think everybody who was around at that time,
holidaymakers and people at the Ocean Club, should be interviewed again.
The timeline needs to be made crystal clear because there is still so
much confusion, such a mess.”
Asked if he
thought Madeleine’s fate would ever be known, he brushed back his thick
dark brown hair, rubbed his tanned chin and said: “I hope so, I believe
it will come out one day.” He said Portugal’s financial crisis means “if
the British do want to get to the bottom of this, it is a case of
funding the Portuguese”.
Mr Murat, who grew up
in Devon and Portugal, now has a young family with wife Michaela. They
were both victims of the relentless media frenzy when Madeleine vanished
and it has left its scars. For the first time during the interview he
became emotional and said in a whisper: “There is no way to describe the
impact this has had on our lives. Six years later it still affects me. I
wasn’t able to do much for years and years.
“It was difficult getting back on the horse, so to speak, and do the stuff I was doing before.”
His
property business went, partly because his computers were held by the
PJ for so long, but now he has built up Newteq, an Apple-authorised
service provider on the Algarve. He said he and Michaela live a quiet
life, staying away from some events because people still come up to him
and say: “You’re that Mr Murat.”
Before 2007 he
says he was one of those people who was always eager to help others, to
get involved in the community. Now he is more guarded.
When
the original police investigation was at its height, he bumped into a
British man, Steve Carpenter, who persuaded him to meet the McCanns
because they needed his language skills. He said: “I met Gerry and said:
‘I don’t know what to say, there is nothing I can say but I do speak
Portuguese and English and I will help in any way I can’.”
He
helped Portugal’s GNR military officers to search the Ocean Club
apartments and translated statements from key witnesses, giving him a
unique inside perspective on the case.
He said: “From the experiences of the interviews there are some points that could be looked at.
“There
needs to be much more transparency, much more openness to dissipate a
lot of the stuff that has been talked about on the internet and on
blogs.”
He does not believe the results of the Yard’s work should be made available to the public.
“The
Yard needs to get together with the Portuguese police and produce a
final report,” he said. “They need to sit down together and come up with
a final version, a structured report.
“The report should be done by the Portuguese with the support of the British.”
Last
week Prime Minister David Cameron had a private meeting with the
McCanns in London, promising them the review would not fall foul of
budget cuts and giving them enough confidence to say on their website
that they hope for a significant breakthrough in the months ahead.
On
Friday night Kate and Gerry, both 45, gathered around a candle which
burns night and day for Madeleine outside their home village of Rothley,
Leicestershire. A 50-strong crowd supported them as they marked the
anniversary with prayers with Madeleine’s siblings, eight-year-old
twins Sean and Amelie.
Mr Murat said: “It must
be a tremendously difficult time of year for them and of course as a
human being you feel for them and for the loss of their daughter.
“At this time of year, like so many people on the Algarve, we have been thinking about this poor girl.
“I just hope in the months ahead the PJ are fully involved because in my view that is the best way of solving the mystery.”
At
St Vincent’s church in Praia da Luz, where Kate and Gerry went
regularly, worshippers also prayed for Madeleine, whose 10th birthday is
on May 12.
Clarence Mitchell, the McCanns’
spokesman, declined to comment on Mr Murat’s views last night, saying
the couple were happy with how Scotland Yard is conducting the review.
Das nebenstehende Bild wurde am Abend des 3. May 2007 bereits an die Polizei verteilt, angeblich ausgedruckt auf einem Drucker einer Mitarbeiterin des Ocean Club. Auf diesem Bild ist Madeleine sicher ca. 1/2 bis 1 Jahr jünger als auf aktuellen Bildern vom Urlaub (Tennisphoto, Spielplatzphoto). Warum hatten die Eltern ein so altes Bild auf ihrer Kamera und warum wurde nicht ein aktuelles Photo zur Suche verwandt? Noch heute ist dieses Bild auf den internationalen Seiten der PJ und Interpol zu sehen. Ausserdem ist dort ihre Größe überall mit 90cm angegeben. 90cm bei einem Kind das kurz vor dem 4. Lebensjahr stand, ist aussergewöhnlich klein und wäre es wert gewesen bei der Suchbeschreibung deutlicher herausgestellt zu werden. Mindestens genauso ungewöhnlich wie der Fleck in ihrem Auge, der merkwürdigerweise nicht in ihrem Pass vermerkt ist, im Gegensatz zu einem Leberfleck am Bein.
An Hand dieses Bildes, das die Maße aus dem Originalkatalog für das Spielhaus verwendet, wäre Madeleine ca. 40" also um die 100 cm groß gewesen.
Warum wurde sowohl ein altes Photo als auch eine evtl. falsche Größe an die Polizei weitergegeben? Mitarbeiter des Ocean Club, die sie nur flüchtig immer in einer Gruppe anderer Kinder gesehen haben, würden sie doch sicher nicht an Hand dieses Bildes und der Größenangabe identifizieren können. War sie evtl. am 3. May schon nicht mehr am leben?
Im Interview mit Sandra Felgueiras gab Gerry McCann das neue Mantra (neben "Teambuilding" mit "good ordinary people" und "inherently good people) bekannt, das er siebenmal wiederholte:
"Es wurde untersucht, die Beweise wurden der Justiz übergeben, und die Justiz kam zu dem Schluß dass es keinen Beweis gab diese These zu unterstützen."
Dies habe ich dazu gefunden:
1. Teil der Untersuchung und vorläufiger Abschlußbericht bevor Goncalo Amaral entlassen wurde:
Madeleine starb im Apartment 5A, eine Entführung wurde vorgetäuscht, Kate und Gerry sind am Verbergen der Leiche beteiligt, es wird momentan von einem Unfall ausgegangen.
2. Teil der Untersuchung und Abschlußbericht unter Leitung von Paulo Rebelo:
Aufgrund der nicht zustande gekommenden Rekonstruktion durch die Weigerung zur Teilnahme aller Freunde der McCanns (Tapas 7) konnten folgende entscheidende Punkte nicht geklärt werden:
- Die Konstellation von Jane Tanner, Gerry McCann und Jeremy Wilkins zum Zeitpunkt der Sichtung des angeblichen Entführers. Die Diskrepanzen in den Zeugenaussagen sind ohne eine Rekonstruktion nicht erklärbar.
- der Zustand des Fensters, ob offen oder geschlossen, hätte durch eine Rekonstruktion anhand von Zugluft, Bewegungen der Vorhänge und Druckluft unterhalb der Tür, geklärt werden können und bleibt somit offen.
- die Zeitschiene, in der die Kinder überprüft wurden, die das Eingreifen eines "Entführers" sehr unwahrscheinlich machte, hätte geklärt werden können.
Der Bericht schliesst damit, das es nicht möglich ist eine solide und objektive Schlußfolgerung über das was wirklich in der Nacht passierte zu erhalten.
Daher werden keine weiteren Empfehlung gegeben, zusätzliche Untersuchungen durchzuführen. Die empfohlenen scheiterten an der Weigerung der Tapas 7.
3. Erklärung zur Archivierung des Falles durch die Oberstaatsanwälte José de Magalhães e Menezes und João Melchior Gomes
Gerade das Nichtzustandekommen der Rekonstruktion wird folgendermaßen ausgelegt:
"wir glauben dass der Hauptschaden die Arguidos McCann traf, die die Möglichkeit verloren zu beweisen, was sie seitdem sie Arguidos sind, beschworen haben: Ihre Unschuld an dem tragischen Ereignis; auch die Untersuchung wurde unterbrochen/gestört, weil genannte Fakten ungeklärt bleiben.
Sieht so der Abschluss einer Kriminaluntersuchung aus, die zweifelsfrei die Unschuld festgestellt hat? Ich denke NEIN!
Am 4. Mai 2007 um 23:15 tätigt David Payne einen 100 Sekunden Anruf an folgende Telefonnummer in England: 0207 230 2061
Meinen Recherchen zufolge handelt es sich hierbei um die Nummer der SO7 Serious and Organised Crime in London, New Scotland Yard. Bei seinem Interview durch die Polizei von Leicestershire war er nicht sehr hilfreich in seinen Antworten bzgl. des Anrufs. Erst nachdem man ihm den Teilnehmer "Crime Specialist Director in London" vorschlug gab er den Anruf zu, wusste aber nichts mehr zum Inhalt zu sagen. Er gab an, diese Nummer von seiner Schwester erhalten zu haben.
Chef dieser Einheit ist Graham McNulty, der die Operation Ainstable leitete, deren Hauptprotagonist, Paul Bennett, zufällig am 14. Juni 2007 am Flughafen von Faro festgenommen werden konnte, nachdem er jahrelang "gesucht" wurde. Alleine die Geschichte, wie Paul Bennett die Briten aufs Kreuz legte, und im Austausch gegen "Waffenverstecke", die er im Gefängnis erst organisierte, nach ein paar Monaten einer über 20-jährigen Haftstrafe freigelassen wurde, gibt Stoff für einen Blockbuster-Mehrteiler.
Sie waren es die ihn wegen Verleumdung vor Gericht brachten und die, die darum bitten, das Urteil auszusetzen um zu verhandeln. Am Vorabend des Prozesses von Goncalo Amaral, gegen den sie die Beschwerde eingebracht haben, baten die McCanns um Verhandlungen.

Nicht oft bittet der Kläger um Verhandlungen aber in diesem Fall war es so. TVmais fand heraus, dass der Anwalt der Eheleute McCann, am Vorabend des Prozesses, ein Treffen vorschlug, um eine außergerichtliche Einigung zu erreichen.
In der Klage verlangten die Eltern von Madeleine McCann Schadenersatz über 1,2 Millionen € von Goncalo Amaral wegen angeblicher Verleumdung. Nun sind sie es, die eine außergerichtliche Einigung vorschlagen. TVmais ist auch bekannt, dass die Anwälte der Beklagten ein Treffen innerhalb der nächsten 20 Tage akzeptiert haben.
Da sich beide Seiten einig sind, wurde der Beginn des Prozesses, der für den 24. diesen Monats am 1. Zivilgericht in Lissabon geplant war, ausgesetzt, weil "die Parteien versuchen wollen eine Einigung zu erzielen," wurde der Lusa Nachrichtenagentur aus juristischen Quellen gesagt. Alle Zeugen wurden bereits über die Aussetzung der Anhörung informiert.
Nun folgt ein Zeitraum von sechs Monaten, nach dem die Anhörung geplant und der Prozess starten wird, sollte es zu keiner Einigung kommen.
“Unpassend”
Dieser Prozess hätte schon zweimal anfangen müssen und wurde genauso oft vertagt.
In dieser Klage beanspruchen Kate und Gerry Mccann weiterhin den Schutz von Rechten und Bürgschaften und um den Betrag zu sichern auf den sie klagen, beantragten die McCanns die Beschlagnahmung von Goncalo Amarals Vermögensgütern.
Um zu verstehen wie er diesen Schritt der McCanns interpretiert, kontaktierten wir Goncalo Amaral, der TVmais sagte, dass "der Abend jeder Verhandlung der unpassendste Moment ist sich zu äußern". Bis zum Redaktionsschluss dieser Ausgabe war es nicht möglich mit dem Ehepaar McCann zu sprechen.
Angeklagte
Der Prozess findet im 1. Gerichtsbezirk des Zivilgerichts in Lissabon statt. Madeleine McCanns Eltern fordern 1,2 Millionen Euro wegen angeblicher Verleumdung. Angeklagt sind Goncalo Amaral, früherer Koordinator der Policia Judiciara und Autor des Buches "Maddie, die Wahrheit über die Lüge", die Herausgeber des Buches Guerra & Paz, Vanlentim de Carvalho, der die auf dem Buch basierende Dokumentation produzierte und TVI, die diese sendeten.
Buch freigegeben
In einem durch das Ehepaar McCann angestrengten Verfahren wurde ein Verbot des Buches und der Dokumentation "Die Wahrheit über die Lüge", in dem Goncalo Amarals Theorie über die Beteiligung der Eltern am Verschwinden ihrer Tochter und am Verbergen ihrer Leiche dargestellt wird, am 9. September 2009 einstweilig verfügt.
Jedoch entschieden das Berufungsgericht und der Oberste Gerichtshof zu Gunsten von Goncalo Amaral und wiesen die Klage der McCanns im November 2010 und im September 2011 zurück.
Wie wir zum Zeitpunkt der Gerichtsentscheidungen berichteten, ordneten die Gerichte vom Treuhänder der Bücher [Isabel Duarte] die Herausgabe der Bücher an Goncalo Amaral und den Herausgeber an. Und so geschah es.
Hênani Carvalho (HC) - Wie Sie wissen, verklagten die McCanns, Madeleines Eltern, Goncalo Amaral wegen Verleumdung. Am Vorabend des Prozesses beantragten sie ein außergerichtliches Treffen mit den einzelnen Beklagten. Wie sie wissen, sind die Beklagten der koordinierende Inspektor Goncalo Amaral, TVI, Valentim de Carvalho und Guerra & Paz. Sie beantragten ein außergerichtliches Treffen. HC - Genau. Außergerichtliche Treffen kurz vor den Prozessen gibt es häufig, aber normalerweise sind es die Beklagten, die dies anstreben.
JP - Die Beklagten, richtig?
HC - ... eine außergerichtliche Lösung.
JP - Nicht derjenige, der anklagt [Kläger], richtig?
HC - Warten wir ab, ob dieses Treffen zu irgendetwas führt, wenn nicht, zumindest hat es dann etwas Zeit erkauft, wem auch immer.
JP - Also was denken Sie? Ist dies eine Verzögerungstaktik? Um Zeit zu gewinnen?
HC - Bis jetzt wurde der Beginn des Prozesses schon zwei oder dreimal vertagt. Die Tatsache, dass alle Parteien zugestimmt haben [dem außergerichtlichen Treffen beantragt von den McCanns] veranlasste den Richter, dem Aussetzen des Prozesses zuzustimmen, daher wird alles in sechs Monaten entweder mit einer außergerichtlichen Einigung oder mit einem Prozess wieder beginnen.
JP - Unglücklicherweise, ohne dass man irgendetwas über Maddie McCann weiß. Dieser Punkt geht nicht voran, bewegt sich nicht mehr vorwärts.
HC - Darüber wissen wir, dass sie aus Praia da Luz verschwand in besagter Nacht aus dem Apartment.
JP - Und sie wurde nie wieder gesehen. Weiter mit....
HC - Sie wurde mehrfach gesehen.
JP - Ich habe schon länger nichts mehr über Sichtungen gehört.
Dies schrieben die Unterstützer der Eltern (oder sie selbst im blog writing-the-wrongs) noch im Oktover letzten Jahres und ich kann ihnen ohne Vorbehalte zustimmen:
The libel case brought by Mr and Mrs McCann
against Snr Amaral for libel has, it seems, stirred all of his
supporters on the internet into something of a frenzy of anticipation.
They seem to look forward, with ill-concealed glee, to certain imaginary
aspects of the case being revealed in the British press that they
mistakenly believe the couple would rather not be made public. It is,
naturally, total nonsense. There are no skeletons in the McCanns’ closet
waiting to fall, because they have acted with complete dignity and
grace from the beginning, and have been completely truthful from day
one. If they had not, who in their right minds would think their
solicitor would allow them to put themselves in such an exposed position
in the first place?
Wenn sie nicht immer die volle Wahrheit gesagt hätten, welcher Anwalt wäre so verrückt, Ihnen zu erlauben, sich in so eine exponierte Position wie einen Gerichtssaal zu begeben....

DETECTIVES have been given a photo which appears to show Madeleine McCann with an abductor.
The
Sunday Express was passed the picture independently but Scotland Yard
appealed to us not to publish it while it continues sensitive global
investigations into the missing girl.
Officers
were happy for us to describe the potentially key evidence which shows a
healthy fair-haired girl aged three or four in pink trousers, a green
top and a blue hat.
The child is walking along a
road, possibly near a port or airport as there are many people with
suitcases in the area. It is sunny with a palm tree in the background.
This is a matter for Scotland Yard and I
am sure they will get to the bottom of it. Kate and Gerry have
confidence in Operation Grange.

The
photograph was allegedly taken in Brazil in June 2007, a month after
Madeleine, three, was snatched from a holiday apartment in Praia da Luz
on Portugal’s Algarve coast.
The girl is holding
the hand of a swarthy foreign-looking man aged about 50 with long dark
hair and a beard. He is wearing cut-off jeans and a green T-shirt.
Nearby,
another man in checked shorts and a black T-shirt is pulling a red
suitcase. There is no sign of a woman and the child looks out of place
with the older men.
If the picture is genuine, it would be the biggest breakthrough in the case to date.
A
Portuguese speaking man living in Brazil forwarded the photo to a
detective on Operation Grange, the Yard squad trying to find Madeleine
by reviewing thousands of documents.

The Yard may send the picture to FBI imaging experts in America for an opinion.
This week the Yard is expected to ask detectives in Brazil to interview
the man before considering whether to fly him to London.
Today Reggie Dunlop, a man living his dreams, did an even more investigative research than the great James Murray and unveiled the above mentioned photograph and the corresponding article:
An excusable mistake by good old James. Brazil and Ibiza are only distinguishable from each other by the "R".
